The rule is the same every time: the return is due the last day of the month following the month of first use. Where that day is a Saturday, Sunday or federal holiday, it moves to the next business day — which is why five of these twelve dates are not month ends.

Deadlines, penalties and late returns

When is Form 2290 due?

For a vehicle that was already in service at the start of the tax period on July 1, the return is due August 31. For a vehicle first used later in the period, it is due the last day of the month following the month of first use — a truck first used in November is due December 31. Where that date falls on a Saturday, Sunday or federal holiday, it moves to the next business day.

Is the deadline based on when I bought the truck?

No. It is based on the month you first used the vehicle on a public highway during the tax period. A truck bought in September and left on the lot until October is an October first-use vehicle, and the return is due November 30.

What happens if I file late?

The IRS charges a failure-to-file penalty of 4.5% of the tax due for each month or part month the return is late, up to five months. If the tax is also unpaid there is a further 0.5% per month, and interest runs on the unpaid balance at the federal short-term rate plus 3%, compounded daily. The practical point is that the penalty stops growing once the return is in, so a late return should be filed today rather than at the next deadline.

Can I file before the deadline?

Yes, and for a vehicle already in service you can file from July 1. Filing early is the sensible move if you have a registration appointment coming up: e-filing returns a stamped Schedule 1 in minutes, but a return the IRS rejects has to be corrected and retransmitted, and you want that to happen with time in hand.

Does the deadline change if I owe no tax?

No. A return reporting only suspended vehicles carries no tax but is still due on the same date, and it still produces the Schedule 1 a DMV will ask for. Owing nothing is not the same as having nothing to file.

I missed the August 31 deadline. What now?

File immediately. You cannot backdate the return and there is no extension to apply for, but the failure-to-file penalty accrues monthly and stops accruing when the return is accepted. You will also need the stamped Schedule 1 before you can renew a registration, so the delay compounds into a second problem.
