Do you need to file Form 2290?

The test is narrower than most people assume and catches more vehicles than they expect. It has nothing to do with crossing state lines, nothing to do with whether you run under your own authority, and nothing to do with how much the truck earns.

The test, in one sentence

You must file if a taxable highway motor vehicle is registered, or required to be registered, in your name under state, District of Columbia, Canadian or Mexican law at the time of its first use during the tax period, and the vehicle has a taxable gross weight of 55,000 pounds or more.

Everything else on this page is a consequence of that sentence. Note what it does not mention: interstate operation, for-hire authority, mileage, or revenue.

It applies to every kind of owner

Individuals, limited liability companies, corporations, partnerships and any other kind of organisation — including nonprofit, charitable and educational ones — all file if the test is met. A sole proprietor with one truck files exactly the same return as a corporation with two hundred.

You need your own EIN to do it. A Social Security number cannot be used on Form 2290 even by an individual.

Taxable gross weight is the part people get wrong

It is not the weight of the empty truck and it is not what the truck scaled last week. It is three things added together: the unloaded weight of the vehicle fully equipped for service, the unloaded weight of any trailers or semitrailers customarily used with it, and the weight of the maximum load customarily carried.

That is why a tractor that weighs 17,000 pounds empty is comfortably over the 55,000 pound threshold in normal operation, and why a straight truck somebody thinks of as "not a big rig" can be taxable.

Exempt owners

Certain owners are not subject to the tax at all. Use by the federal government, the District of Columbia, a state or local government, the American National Red Cross, a nonprofit volunteer fire department, ambulance association or rescue squad, an Indian tribal government for essential tribal government functions, or a mass transportation authority is exempt.

This is an exemption on the owner, not a suspension based on mileage — the two are frequently confused, and they produce different treatment on the return.

Exempt vehicles

  • Qualified blood collector vehicles used at least 80% of the time for blood collection and transport.
  • Mobile machinery with permanently mounted equipment for construction, manufacturing, drilling, mining, timbering or processing.
  • Vehicles specially designed for off-highway transportation.
  • Non-transportation trailers and semitrailers.

You may have to file even when you owe nothing

A vehicle expected to run 5,000 miles or less during the period (7,500 for an agricultural vehicle) is suspended and carries no tax — but it is still reported on the return and still appears on the Schedule 1. Since the Schedule 1 is what a DMV asks for at registration, a suspended-only return is usually essential rather than optional.

Owing nothing and having nothing to file are different situations, and only one of them lets you skip the return.

If you are unsure whether a vehicle is over the threshold, work out the taxable gross weight properly rather than estimating. The calculator shows the category letter as well as the tax, and the letter is what a DMV reads off the Schedule 1.

Which return, and when

If the vehicle was already in service at the start of the period on 1 July, the return is due 31 August. If it was first used later in the period, it is due the last day of the month following that first use — and that is a separate return, not something to add to the next August filing.
